For 27 years the city of Marietta has been doing studies on the municipal court to try to determine what could be done with the facility to better suit the needs of the court. A district court ruling released last week says it's time for the city to stop studying and take some action to remedy the situation.
In a unanimous decision, the three member court concurred that the municipal court in wholly inadequate. Five pages of findings spell out the inadequacies.
Judge Janet Dyar Welch says the building was suitable at one time, but that was a long time ago. She said the district court's decision may help the issue finally move forward.
City council members will meet with the law director this evening to review their options. An appeal is possible. If the matter is appealed, it would be to the Ohio Supreme Court. The city has 45 days to file a notice.
